We are trying to get an inheritance tax entry on the land registry removed. No inheritance was ever due. How can we get this entry removed. Thanks

The title number is WR178658 and I am not sure of the actual wording but it is about inheritance tax. We have been asked to supply a Certificate of discharge from the Inheritance Tax Office but no inheritance tax was ever due. Thanks

Jayne - many thanks but there is a pending application against that title. we contacted the lodging conveyancer for 'more', and they have now submitted that and are asking if it is sufficient to remove the entry

Jayne - sorry for the delay but I understand we have written to the lodging conveyancer for more details. That will presumably be referred to your own conveyancer so I would suggest speaking to them first before trying to resolve the matter
Whilst the certificate of discharge is one option the other is for your conveyancer to certify certain facts so that may be the route to go here

We seem to have tried everything. No inheritance tax has ever been due so we cannot get a discharge certificate. Just going round in circles

Jayne - accepted by whom? If you mean us then we will only accept a certificate of discharge as formal evidence. As you don’t have one we will accept the alternative, namely a conveyancer’s certificate confirming none was payable and including the appropriate details. That has been confirmed to the lodging conveyancer.
So if you mean your conveyancer won’t accept the evidence you need to ask them what else they need to enable them to provide that certificate

Hi Adam I believe the entry has now been removed. I wonder if you can help with something else. When the first registry was completed I believe a letter should be sent out asking about inheritance tax. Is there any way that we can find out who that letter was sent to. Thanks again for your help

Jayne - it has been removed and the application completed
Notification of the entry will have been confirmed in writing to the conveyancer who lodged the application to register back in May 2018. Presumably your and the joint owner's conveyancer at that time.
